Citizens from across Washington participating in the annual Humane Lobby Day assembled at the state capital on Monday to rally in support of animal protection legislation and to meet with lawmakers to urge them to pass animal protection bills.

Humane Lobby Day was hosted by The Humane Society of the United States, ASPCA (The American Society for the Prevention of Cruelty to Animals?) and Wolf Haven International. Members of the Washington Alliance for Humane Legislation also participated.

?This session, legislators have a chance to improve animal cruelty provisions, make strides toward protecting shark populations and ban the inhumane and unnecessary farming practice of removing dairy cows? tails,? said Dan Paul, The HSUS? Washington state director. ?Face-to-face meetings between lawmakers, staff and committed citizens are an important step toward reducing animal suffering.??

?Humane Lobby Day is a great forum for both veteran citizen-lobbyists as well as new advocates looking to help animals for the first time,? said Kevin O?Neill, state director of ASPCA Government Relations for the Western region. ?Since the Washington Legislature has convened for 2013, several bills have been introduced and legislators take note when their constituents take the time out of their busy schedules to visit them in the Capitol. We look forward to our continued work with the people of Washington to further the cause of animal protection throughout the state.?

During the event, The HSUS presented Rep. Hans Dunshee, D-44, with the 2012 Humane Legislator of the Year Award for his years of strong leadership regarding animal protection.

Humane Lobby Day attendees urged their legislators to support the following bills:

  • Forthcoming legislation to ban the routine docking of dairy cows? tails.
  • HB 1201/SB 5203 - Prohibits selling, bartering, or auctioning of animals upon certain public property or upon certain private property open to the public.
  • HB 1202/SB 5204 - Modifies animal cruelty provisions relating to the crimes of animal cruelty in the first and second degree, animal fighting, and leaving and/or confining an animal in a motor vehicle or certain enclosed spaces.
  • SB 5081 ? Strengthens state ban on shark fins and derivative products. ?Finning? is an abhorrent practice that involves slicing off the fins of a shark and discarding the animal at sea to drown or bleed to death. Unsustainable fishing methods like this have led to declines by as much as 90 percent in some shark populations during recent decades. A ban on shark fin products is the most effective way to eliminate the demand for shark fins and to eradicate shark finning around the world.??

3 arrested in credit card theft from church

Three suspects in a series of area thefts, including while seeking "donations" at an Orion Township Sunday church service, are in custody and expected to face charges of stealing a parishioner's purse and credit cards.

On Jan. 20, two of the suspects approached parishioners at the Church of Christ on Hemingway Road during a church service asking church members for gas money or a donation so the three ? a mother, father and daughter ? could return to Tennessee, according to Oakland County Sheriff's deputies.

After they left the service, one church member noticed her purse was missing. The victim later reported the theft and upon contacting her credit card companies learned the stolen credit cards had been used at several area businesses.

Deputies obtained a surveillance video from a Meijer store in Auburn Hills, which showed three suspects together in the store and one using the stolen credit card. All three suspects left the store at different times and the vehicle they were seen using was also identified by the video.

Investigators put out a "be-on-lookout" message to Metro Detroit police agencies seeking help in identifying the suspects.

On Jan. 25 West Bloomfield police reported they had located the vehicle and identified the suspects who allegedly had been involved in a retail fraud in West Bloomfield.

Detectives from the Orion Township substation obtained a search warrant for a room at the Highlander Motel in Waterford Township, where the suspects had been living and their car was parked outside. Detectives recovered evidence including property related to the purse theft and credit card fraud.

Detectives learned the three suspects had been staying in Oakland County for the last 10 days after leaving Tennessee and the three are being investigated for other area property theft crimes. One of the suspects is in custody on an unrelated charge.

Two of the three suspects are expected to be charged in the Orion Township crime and detectives are crediting video surveillance photographs and crime information sharing practices with identifying the suspects and solving the crimes.

The Yeshiva World U.S. Appeals Court Shields SEC From Madoff ...

Investors who said they lost money in Bernard Madoff?s fraud may not pursue a lawsuit against the U.S. Securities and Exchange Commission for missing the swindler?s Ponzi scheme, a federal appeals court said on Monday.

The 9th U.S. Circuit Court of Appeals in Pasadena, California said a federal district judge correctly dismissed their lawsuit seeking to hold the SEC responsible under the Federal Tort Claims Act.

Citing a 2009 report by the regulator?s inspector general, investors led by Dichter-Mad Family Partners LLP in Florida said they would not have invested with Madoff had the regulator availed itself of ?multiple opportunities? to stop the fraud.

They said they instead relied on the regulator?s ?implied stamp of approval? prior to investing, and sought to recover losses they attributed to SEC negligence.

But the 9th Circuit in an unsigned order said the plaintiffs? claims fell within the regulator?s ?discretionary functions,? depriving courts of jurisdiction to hear the appeal.

?I respectfully disagree with the decision, and intend to seek further appellate review,? Richard Gordon, a lawyer who is one of the plaintiffs and argued the appeal, said in a telephone interview.

SEC spokesman John Nester said in an email: ?The decision speaks for itself.?

Monday?s order upheld an April 2010 ruling by U.S. District Judge Stephen Wilson in Los Angeles.

In April 2011, a Manhattan federal judge dismissed a similar lawsuit by two other Madoff investors.

An exhaustive August 2009 report by SEC Inspector General David Kotz outlined how the regulator failed to uncover Madoff?s fraud by missing many red flags, disregarding tips, and failing to follow up properly on leads.

Madoff, 74, pleaded guilty in March 2009 and is serving a 150-year prison sentence.

US economy gets lift from housing, other tailwinds

WASHINGTON (AP) -- The U.S. economy is a study in contrasts.

The housing, banking and auto industries are surging back to health and that has helped push the stock market to a five-year peak. Higher prices for homes and stocks tend to make people feel wealthier and spend more.

Yet unemployment remains high and hiring modest. The end of a Social Security tax cut is shrinking already flat pay. Federal budget fights have put businesses and consumers on edge.

Balanced between those tailwinds and headwinds, the economy is struggling to accelerate. By the end of this year, though, many analysts think the tailwinds will succeed in boosting growth and fueling a more robust economy in 2014.

They're back: J. C. Penney adds sales

NEW YORK (AP) -- J.C. Penney is bringing back sales.

The struggling department store chain this week will begin adding back some of the hundreds of sales it ditched last year in hopes of luring shoppers who were turned off when the discounts disappeared, CEO Ron Johnson told The Associated Press.

Penney also plans to add price tags or signs for more than half of its merchandise to show customers how much they're saving by shopping at the chain ? a strategy used by a few other retailers. For store branded items such as Arizona, Penney will show comparison prices from competitors.

The moves are a reversal for Penney on the eve of the one-year anniversary when it vowed to almost completely get rid of the sales that Americans covet but that cut into a store's profits. The idea was to offer everyday low prices that customers could count on rather than the nearly 600 fleeting discounts, coupons and sales it once offered.

Toyota sold nearly 9.75 million vehicles last year

TOKYO (AP) -- Now it's official: Toyota is once again the world's top automaker.

Toyota Motor Corp. released its tally for global vehicle sales for last year Monday at a record 9.748 million vehicles ? a bigger number than the estimate it gave last month of about 9.7 million vehicles.

It was already clear Toyota had dethroned General Motors Co. as the Detroit-based automaker fell short, selling 9.29 million vehicles.

GM had been the top-selling automaker for more than seven decades before losing the title to Toyota in 2008.

Crucial, long-overdue BlackBerry makeover arrives

TORONTO (AP) -- The maker of the BlackBerry smartphone is promising a speedier device, a superb typing experience and the ability to keep work and personal identities separate on the same phone. It's the fruit of a crucial, long-overdue makeover for the Canadian company.

Thorsten Heins, chief executive of Research In Motion Ltd., will show off the first phone with the new BlackBerry 10 system in New York on Wednesday. A marketing campaign that includes a Super Bowl ad will accompany the long-anticipated debut. Repeated delays have left the once-pioneering BlackBerry an afterthought in the shadow of Apple's trend-setting iPhone and Google's Android-driven devices.

Now, there's some optimism. Previews of the software have gotten favorable reviews on blogs. Financial analysts are starting to see some slight room for a comeback. RIM's stock has nearly tripled to $16.18 from a nine-year low in September, though it's still nearly 90 percent below its 2008 peak of $147.

US durable goods orders rise 4.6 percent on aircraft

WASHINGTON (AP) -- U.S. demand for long-lasting manufactured goods rose sharply in December on strong gains in volatile aircraft orders. But companies slowed their orders of goods that signal investment plans, indicating manufacturing could stay choppy in 2013.

The Commerce Department said Monday that overall orders for durable goods increased 4.6 percent in December compared with November. The gains were led by a 56.4 percent increase in military aircraft orders and a 10.1 percent increase in commercial aircraft orders.

Orders rose in other major categories, including machinery, communications equipment and primary metals.

Tight inventory slows US pending home sales

WASHINGTON (AP) -- A measure of Americans who signed contracts to buy homes fell last month after reaching a 2 ?-year high in November. Sales were held back by a limited supply of available homes.

The National Association of Realtors said Monday that its seasonally adjusted index for pending home sales dropped 4.3 percent in December from November to 101.7. That's still 6.9 percent higher than a year ago.

The decline signals that sales of previously occupied homes may cool off in the coming months. There's generally a one- to two-month lag between a signed contract and a completed sale.

Yahoo's 4Q report shows more signs of progress

SAN FRANCISCO (AP) -- Yahoo showed more signs of progress during the fourth quarter as the Internet company took advantage of higher ad prices and rising earnings from its international investments to deliver numbers that exceeded analyst forecasts.

The results announced Monday covered Yahoo's first full quarter under CEO Marissa Mayer. Yahoo Inc. lured Mayer away from Google Inc. in mid-July in its latest attempt to snap out of a funk that had depressed its revenue and stock price.

The company fared well enough in the final three months of last year to produce its first full-year gain in revenue since 2008.

Caterpillar sees uncertain 2013 after tough 4Q

MINNEAPOLIS (AP) -- Caterpillar said on Monday that its 2013 profit could shrink if the world's economy doesn't pick up in the second half of the year, as mining companies and builders remain cautious about buying new gear.

The cloudy outlook for the year came as Caterpillar reported a fourth-quarter profit less than half as big as a year ago because of a deal in China that went bad and slower growth around most of the world.

Caterpillar Inc. is the largest maker of construction and mining equipment, so its performance rises and falls with the world's economy. It tries to predict where the economy is headed so it knows how many excavators, bulldozers and mining trucks to build.

Boeing 787 probe shifts to monitoring system maker

TOKYO (AP) -- The joint U.S. and Japanese investigation into the Boeing 787's battery problems has shifted from the battery-maker to the manufacturer of a monitoring system.

Japan transport ministry official Shigeru Takano said Monday the probe into battery-maker GS Yuasa was over for now as no evidence was found it was the source of the problems.

Ministry officials said they will inspect Kanto Aircraft Instrument Co. on Monday as part of the ongoing investigation. It makes a system that monitors voltage, charging and temperature of the lithium-ion batteries.

Barnes & Noble executive plans more store closings

NEW YORK (AP) -- Barnes & Noble plans to continue to shrink its store base.

The head of Barnes & Noble's retail group, Mitchel Klipper, said in an interview published Monday in The Wall Street Journal that the company will have 450 to 500 stores in a decade. That's down from about 689 currently.

Klipper said the chain plans to close about 20 stores a year over the period.

The largest traditional U.S. bookstore has been facing tough competition from online retailers and discounters

Army says political tussle taking Egypt to brink

CAIRO, Egypt (Reuters) - Egypt's army chief said political strife was pushing the state to the brink of collapse - a stark warning from the institution that ran the country until last year, as Cairo's first elected leader struggles to contain bloody street violence.

General Abdel Fattah al-Sisi, appointed by President Mohamed Mursi last year to head the military, added in a statement on Tuesday that one of the primary goals of deploying troops in cities on the Suez Canal was to protect the waterway that is vital for Egypt's economy and world trade.

Sisi's comments, published on an official army Facebook page, followed 52 deaths in the past week of disorder and highlighted the mounting sense of crisis facing Egypt and its Islamist head of state who is struggling to fix a teetering economy and needs to prepare Egypt for a parliamentary election in a few months that is meant to cement the new democracy.

The comments are unlikely to mean the army wants to take back the power it held, in effect, for six decades since the end of the colonial period and in the interim period after the overthrow of former general Hosni Mubarak two years ago.

But it sends a powerful message that the Egypt's biggest institution, with a huge economic as well as security role and a recipient of massive direct U.S. subsidies, is worried about the fate of the nation after five days of turmoil in major cities.

"The continuation of the struggle of the different political forces ... over the management of state affairs could lead to the collapse of the state," said General Abdel Fattah al-Sisi, who is also defence minister in the government Mursi appointed.

He said the economic, political and social challenges facing the country represented "a real threat to the security of Egypt and the cohesiveness of the Egyptian state" and the army would remain "the solid and cohesive block" on which the state rests.

Sisi was appointed by Mursi after the army handed over power to the new president in June. Mursi sacked Field Marshal Hussein Tantawi, who had been in charge of Egypt during the transition and who had also been Mubarak's defence minister for 20 years.

Political opponents spurned a call by Mursi for talks on Monday to try to end the violence. Instead, huge crowds of protesters took to the streets in Cairo and Alexandria, and in the three Suez Canal cities - Port Said, Ismailia and Suez - where Mursi on Sunday imposed emergency rule and a curfew.

"DOWN, DOWN MURSI"

Residents in the three canal cities demonstrated overnight in defiance of the curfew. At least two men died in fighting in Port Said, raising to at least 42 people who have now been killed there, most of them by gunshot wounds.

Protests first flared to mark the second anniversary of the uprising that erupted on January 25, 2011 and toppled Mubarak 18 days later. They have been exacerbated by riots in Port Said by residents enraged by a court ruling sentencing several people from the city to death over deadly soccer violence last year.

"Down, down with Mohamed Mursi! Down, down with the state of emergency!" crowds shouted in Ismailia. In Cairo, flames lit up the night sky as protesters set vehicles ablaze.

The demonstrators accuse Mursi of betraying the two-year-old revolution. Mursi and his supporters in the Muslim Brotherhood accuse the protesters of seeking to overthrow Egypt's first ever democratically elected leader by undemocratic means.

Debris from days of unrest was strewn on the streets around Cairo's Tahrir Square, cauldron of the anti-Mubarak uprising.

Youths clambered over a burned-out police van. But unlike on previous mornings in the past few days, there was no early sign of renewed clashes with police.

Since the 2011 revolt, Islamists who Mubarak spent his 30-year rule suppressing have won two referendums, two parliamentary elections and a presidential vote.

But that legitimacy has been challenged by an opposition that accuses Mursi of imposing a new form of authoritarianism, and punctuated by repeated waves of unrest that have prevented a return to stability in the most populous Arab state.

U.S. UNEASE

The army has already been deployed in Port Said and Suez and the government agreed a measure to let soldiers arrest civilians as part of the state of emergency.

The instability has provoked unease in Western capitals, where officials worry about the direction of a powerful regional player that has a peace deal with Israel. The United States condemned the bloodshed and called on Egyptian leaders to make clear violence is not acceptable. .

Mursi's invitation to rivals to hold a national dialogue with Islamists on Monday was spurned by the main opposition National Salvation Front coalition, which described it as "cosmetic".

The only liberal politician who attended, Ayman Nour, told Egypt's al-Hayat channel after the meeting ended late on Monday that attendees agreed to meet again in a week.

He said Mursi had promised to look at changes to the constitution requested by the opposition but did not consider the opposition's request for a government of national unity. Mursi's pushing through last month of a new constitution which critics see as too Islamic remains a bone of contention.

The president announced the emergency measures on television on Sunday. "The protection of the nation is the responsibility of everyone. We will confront any threat to its security with force and firmness within the remit of the law," Mursi said.

Farmers Insurance Open leaderboard: Tiger Woods extends lead at ...

Tiger Woods birdied two of his first four holes to start the third round of a tournament that could turn into a runaway.

The sun has finally come out at Torrey Pines, and the resumption of play at the Farmers Insurance Open could mean a runaway win for Tiger Woods. The seven-time winner at the South Course has a scoring average of 68.75 on this layout, and he opened his third round on Sunday morning with two massive drives down the middle of the fairway. A two-shot lead quickly became a three-shot lead, and Woods added to that again on his first par-3 of the day to move to 13-under.

At the par-3 third hole, with a scenic backdrop comparable to No. 7 at Pebble, Woods took dead aim at the flagstick and hit the best shot of the day on the hole. From about 200 yards, he sent his tee shot high into the air and dropped it straight down on top of the hole, stopping it two feet from the cup.

There was a bit of a backup at the third hole, with multiple groups on the tee waiting on the par-3. Woods, however, was at ease, cracking jokes with his playing partners and Erik Compton, who's playing in the group ahead of him. But after the lengthy wait, Woods stepped up and fired his second straight dart of an approach shot for a second straight birdie.

Woods had his first miss of the day on the fourth hole, which he double bogeyed the last time he played it in Thursday's first round. Tiger sent his drive way right, over the gallery and across the cart path lining the right side of the fairway. It was the good side to miss, as the cliffs down to the Pacific Ocean line the left side. With that threat looming, Tiger made sure to send it well right.

But unlike Thursday when he hit a spectator, Woods was able to get his approach shot on the green, even if it was more than 40 feet from the hole. He sent a nice lag up a tier to where the hole was, winding it dramatically from right to left to set up an easy two-putt par.

It was looking like the final 27 holes might become a victory march for Woods, but he did finally drop a shot on No. 5 when he could not get up and down from the greenside rough. Woods missed his par putt on the low side, reducing his lead back to three shots. But with no big names making any moves ahead of him, if Woods simply avoids a blow-up hole, he'll have the lead as the final round starts.

Friend or foe: U.S. wary of Muslim Brotherhood

WASHINGTON (AP) ? President Barack Obama begins his second term straining to maintain a good relationship with Egypt, an important U.S. ally whose president is a conservative Islamist walking a fine line between acting as a moderate peace broker and keeping his Muslim Brotherhood party happy with anti-American rhetoric.

The White House last summer had hoped to smooth over some of the traditional tensions between Washington and the Brotherhood, a party rooted in opposition to Israel and the U.S., when Egypt overthrew dictator Hosni Mubarak and picked Mohammed Morsi as its first democratically elected leader.

But a spate of recent steps ? from Brotherhood-led attacks on protesters, to vague protestations of women's freedoms in the nation's new constitution, to revelations of old comments by Morsi referring to Jews as "bloodsuckers" and "pigs" ? have raised alarm among senior U.S. officials and threatens $1 billion in American aid to Egypt.

Though the Brotherhood was founded in Egypt, its influence and affiliates have spread across the Mideast and into North Africa ? where two recent terrorist attacks and a French assault on Islamist militants in Mali have presented Obama with a new front in the battle against extremism for his second term.

The White House has little interest in picking a fight with the Muslim Brotherhood, which has grown in size and stature across the region since the Arab Spring revolts. The Brotherhood and similar Islamist movements are regarded warily by monarchies in Jordan, Kuwait, Saudi Arabia, the United Arab Emirates and Morocco. Its members are part of the opposition coalition seeking to oust Syrian President Bashar Assad. It has small followings in Qatar, Algeria, and a like-minded ? although not officially affiliated ? ally in Tunisia.

When Egyptians elected Morsi, he offered words of moderation, brokered a cease-fire between Israelis and Palestinians in Gaza and bore down on terrorist dens in the Sinai Peninsula.

The Morsi-led government is "a new administration and they're obviously having growing pains," said a senior Obama administration official who agreed to speak on condition of anonymity so he could discuss the diplomatic relationship more candidly.

Since the Tahrir Square revolution two years ago, Washington has tried to help Egypt build a democratic state without appearing to tread on its sovereignty. Morsi won election last June with 51 percent of Egypt's vote.

A new eruption of political violence in Egypt over the weekend left about 50 people dead, deepening the malaise as the Morsi struggles to get a grip on enormous social and economic problems. He has declared a 30-day state of emergency and curfew in the three Suez Canal provinces hit hardest by the violence.

The White House is increasingly concerned about the direction the Brotherhood is taking Egypt: "It's not just about majority rule," the administration official said. "There are democratic principles that we continue to support."

Morsi's anti-Semitic comments, made in separate speeches in 2010 but which surfaced this month on Egyptian TV, also accused Obama of being a liar. They shocked U.S. officials who sprang to condemn them as counter-productive to American-supported peace efforts in the Mideast. But they surprised few people in Egypt, who have heard Brotherhood officials make similar statements for years.

Morsi initially struggled to respond to the U.S. backlash from the comments. His office issued a statement committing to uphold religious freedoms and tolerance, and condemning violence.

"The president strongly believes that we must respect and indeed celebrate our common humanity, and does not accept or condone derogatory statements regarding any religious or ethnic group," the statement said, without addressing the fact that Morsi himself made those comments.

The statement, however, did little to soothe U.S. lawmakers ? Democrats and Republicans alike ? who have balked at approving $1 billion in aid to Egypt that Obama promised in 2011 to help the new government settle an economic crisis that has drained the country's central bank and devalued the local currency in the revolution's aftermath.

"How would the American people feel about cutting money to education programs here and giving money to a government that is anti-Semitic?" Rep. Frank Wolf, R-Va., a member of the House Appropriations subcommittee that oversees funding to foreign governments, said.

"I don't think the administration has any right to say they are going to grant this foreign aid because I think this Congress may very well condition it," Wolf said. "I think there are a lot of questions, and I don't think it's a given."

Part of the proposed $1 billion aid package depends on International Monetary Fund approval of its own $4.8 billion loan to Egypt. But that loan has stalled for months because of Egypt's instability.

Despite its misgivings about Morsi, the White House still is pushing Congress for the funding, acknowledging that Egypt's downfall all but certainly would roil the already turbulent Mideast and North Africa.

"It's not in our interest to have an economic collapse in Egypt," said the senior Obama administration official.

The Brotherhood describes itself as a non-violent social organization dedicated to instilling Islamic values in the society. In Egypt, where it formed, the group was repressed by former regimes for decades and has struggled with adjusting to its new role leading the government. Its members, fearing a coup, are widely blamed with attacking anti-Morsi protesters outside the presidential palace in Cairo last month in clashes that left at least 10 people dead.

"What they missed was the fact that they are a governing party now, and to be getting into street battles when you also have commanding presence in the Egyptian state shows inexperience and panic," said Nathan Brown, a professor at George Washington University who has been researching Islamic movements for nearly a decade. "This is the kind of group that will be a pain to deal with for the United States, but it's not al-Qaida; it's not a security threat."

He added: "The biggest fear on the part of the (Obama) administration is a political breakdown in Egypt. They are worried that a collapse in the Egyptian state would be destabilizing on the region, and might allow the flow of arms and fighters among more radical movements in the region ? especially in trouble spots like Sinai and Gaza."

Obama administration officials said Morsi's promises to abide by Egypt's 1979 peace treaty with Israel, and continued security cooperation with Israel over the volatile Sinai Peninsula shows his willingness to be a reasonable partner. Morsi's work in November to broker a cease-fire between Israel and Gaza's Hamas rules was "a good first step," the senior Obama administration official said.

But Washington remains wary of Morsi and the Muslim Brotherhood, "who come from a very conservative viewpoint with issues that are very important to America," said Sen. Kirsten Gillibrand, D-N.Y.

Gillibrand was part of a delegation of U.S. lawmakers who met with Morsi in Cairo this month shortly after his 2010 statements surfaced. She stopped short of saying Morsi appeared chastened but described him as mindful of "how important America is to the viability of his presidency and the economy."

She said lawmakers want to see what actions he takes, "and we want to see if his words match those deeds and actions," Gillibrand said.

Disabled students must have ?equal access? to school sports,?the U.S. Education Department ruled Friday. If there?s no ?reasonable? way to include disabled athletes on school teams, schools must set up separate programs.

?Participation in extracurricular athletics can be a critical part of a student?s overall educational experience,? said Seth Galanter, of the department?s civil rights office. ?Schools must ensure equal access to that rewarding experience for students with disabilities,? he added.

The directive doesn?t require schools to open sports teams to everyone, regardless of athletic ability, officials said. But it?s not all clear what will be considered ?reasonable.? One example ? providing ?visual clues? in addition to a starter pistol to allow hearing disabled students to compete in track events ? seems like the sort of thing any school would and should do. The second ? waiving the ?two-hand touch? finish at swim meets to allow one-armed swimmers to compete ? also seems fair. But it raises a question: Can a one-armed student swim fast enough to make the team?

In 1972, Title IX forced schools to offer equal athletic opportunities to girls. But there are lots of girls in high schools. There aren?t that many one-armed students who want to compete in swimming.

It was also welcomed by disabled student competitors, among them Casey Followay, a 15-year-old high school track athlete confined to a wheelchair by a birth defect, who under current rules, has to race on his own.

?This will help me become a better athlete conditioning- wise, because I have something to push for,? said Followay, who filed a complaint with the U.S. Office of Civil Rights in 2011 asking that he be allowed to run alongside, but not against, the able-bodied.

If he?s not running against able-bodied runners, is he really on the team? He needs to compete against other wheelchair athletes. Schools are supposed to work with community groups to set up regional teams, if they don?t have enough disabled athletes in each sport. That could be expensive.

?The problem is this was done without any deliberation in Congress and no public input and it is not clear how expansive it will be,? says Fordham?s Mike Petrilli. ?Just how far must a school district go to be compliant??

Thousands to march against gun violence in Washington

WASHINGTON (Reuters) - Residents of Newtown, Connecticut, site of a mass school shooting that reignited the U.S. gun violence debate, will take part in a Washington march for gun control on Saturday with activists, politicians and actors.

Thousands of protesters were expected for the rally on the National Mall, part of about a dozen across the United States in favor of gun control, organizers said in a statement.

Demonstrators will gather at the Capitol Reflecting Pool and march down Constitution Avenue toward the Washington Monument at 11 a.m. A rally was scheduled to take place near the monument just before noon.

Molly Smith, artistic director of Washington's Arena Stage, and her partner organized the march. They were motivated by the December 14 massacre that killed 20 first-graders and six adults at Sandy Hook Elementary School in Newtown.

Politicians from Maryland and the District of Columbia, including Washington Mayor Vincent Gray, were scheduled to speak. Actress Kathleen Turner, star of such movies as "Body Heat," was among the scheduled speakers.

The march comes a week after gun rights supporters held rallies across the country to oppose firearms control.

The Newtown massacre has galvanized the U.S. debate on guns and spurred President Barack Obama to propose the most significant gun-control steps in decades.

Obama wants to revive a ban on military-style assault weapons, a proposal that faces a tough battle in Congress. He also wants to put in place mandatory background checks for all gun buyers, a step viewed as having a better chance of success.

Gun ownership rights are enshrined in the U.S. Constitution. They are closely guarded by gun advocates, such as the National Rifle Association.

About 11,100 Americans died in gun-related killings in 2011, according to preliminary data from the U.S. Centers for Disease Control and Prevention. There were 19,766 suicides by firearms in 2011, the CDC said.

The Washington rally is co-sponsored by One Million Moms for Gun Control, which is organizing about a dozen similar events in cities that include San Francisco and Austin, Texas.

Cows fed flaxseed produce more nutritious dairy products

Jan. 25, 2013 ? Dairy cows that are fed flaxseed produce more nutritious milk, according to a new study by Oregon State University.

Their milk contained more omega-3 fatty acids and less saturated fat, the study found. Diets high in saturated fat can increase cholesterol and cause heart disease, while those rich in omega-3 and other polyunsaturated fatty acids may reduce the risk of heart disease, studies have shown.

Traditional cattle feed mixtures of corn, grains, alfalfa hay and grass silage result in dairy products with low concentrations of omega-3 and other polyunsaturated fats, according to Gerd Bobe, the lead scientist on the study, which has been published online in the Journal of Dairy Science.

Ten pregnant cows at OSU's dairy were fed different amounts of flaxseed -- up to seven percent of their daily diet. Researchers attempted to pinpoint the amount of flaxseed that would maximize the amount of omega-3 in milk and dairy products without negatively affecting their production and texture.

"We were looking for a sweet spot," said Bobe, an expert in human and animal nutrition. "Too much of a good thing can be bad, especially when trying to maintain consistency with dairy products."

Collaborators in OSU's food science and technology department assisted in turning milk into butter and fresh cheese, which were then tested for texture and nutritional composition.

The study found that feeding cows up to six pounds of extruded flaxseed improved the fat profile without negatively affecting the production and texture of the milk and other dairy products. Extrusion presses raw ground flaxseed into pellets with heat.

At six pounds per day, saturated fatty acids in whole milk fat dropped 18 percent, poly-unsaturated fatty acids increased 82 percent, and omega-3 levels rose 70 percent compared to feeding no flaxseed. Similar improvements were observed in butter and cheese.

Still, saturated fat accounted for more than half of the fatty acids in the dairy products while the increase in polyunsaturated fats compromised no more than nearly nine percent of the total.

Researchers also noted that the refrigerated butter was softer and less adhesive thanks to fewer saturated fatty acids. Also, the cows produced the same amount of milk while eating flaxseed.

Although flaxseed costs more than traditional cattle feeds, Bobe hopes that it still could be an affordable feed supplement for cows because products enriched with omega-3 can sell for a premium at the grocery store.

"Many consumers already show a willingness to pay extra for value-added foods, like omega-3 enriched milk," he said.

One thing is for sure, he said: Dairy farmers will have no trouble convincing cows to eat flaxseed.

"They loved it. They ate it like candy," he said.

Dead dolphin removed from toxic New York City canal

NEW YORK (Reuters) - The carcass of a dolphin that died after becoming mired in a notoriously toxic New York City canal has been removed and will be sent for a necropsy, a marine research group said on Saturday.

The animal, a common dolphin, was first spotted in Brooklyn's Gowanus Canal on Friday morning, where it was described as looking disoriented and unwell as it struggled to avoid getting bogged down in the canal's muddy floor.

Biologists from the Riverhead Foundation for Marine Research and Preservation, who monitored the dolphin with police and a crowd of onlookers, hoped the animal might be able to free itself and head back out to the harbor as waters rose. It died Friday evening before high tide.

"The option that gave the animal the best chance for a positive outcome was waiting," Robert DiGiovanni, Riverhead's executive director and senior biologist, said on Saturday. "If an animal wasn't going to be able to survive through the next tide cycle then it was an animal that was compromised and wouldn't make it."

Approaching the dolphin by boat would have been difficult in the shallow, polluted canal and may have achieved little besides adding to the animal's distress, he said.

A necropsy will be performed on the adult dolphin, estimated to weigh about 200 pounds, on Sunday at Riverhead's laboratory on Long Island, he said. The findings and tissue samples will be shared with the National Oceanic and Atmospheric Administration.

Common dolphins are social animals that travel in groups known as pods. To see a solitary common dolphin, especially so far inland, is unusual, and is a sign that the animal is sick or dying, biologists and other marine officials said.

The dolphin's unusual trek into Brooklyn - DiGiovanni could not recall a dolphin coming so far into New York City in at least two decades - brought wide attention to one of the city's dirtier and most malodorous corners.

The Environmental Protection Agency declared the Gowanus Canal a Superfund site in 2010, calling it one of the country's "most extensively contaminated water bodies." Mayor Michael Bloomberg had opposed the designation, arguing the city's own plan would have cleaned the canal in less time.

The canal is laced with heavy metals, coal tar wastes and other pollutants from the factories and tanneries that have lined its banks, the EPA says.

The EPA is still working on its plan, which is currently open to public comment, to spend an estimated $300 million to $400 million of federal money to clean up the canal.

NEW YORK (Reuters) - The Standard & Poor's 500 index closed above 1,500 for the first time in more than five years on Friday as strong earnings reports, including Procter & Gamble's, helped the benchmark extend its rally to eight days.

The winning streak is the longest in eight years and left the S&P 500 about 4.1 percent away from its all-time closing high of 1,565.15 on October 9, 2007.

The equity market's strong start this year has been attributed to solid corporate results, an agreement in Washington to extend the government's borrowing power, encouraging signs from the global economy and seasonal inflows into stocks.

Procter & Gamble shares led the Dow and S&P higher with a 4 percent gain to $73.25 after the world's top household products maker's quarterly profit soared past expectations. The company also raised its sales and earnings outlook for the fiscal year.

Sales of new U.S. single-family homes fell in December but rose in 2012 to the highest level since 2009, a sign the U.S. housing market turned a corner last year.

"Economic data in the U.S. has been trending higher, albeit modestly. Things are incrementally better," said Quincy Krosby, market strategist at Prudential Financial in Newark, New Jersey.

The Dow Jones industrial average <.dji> rose 70.65 points or 0.51 percent, to close at 13,895.98. The S&P 500 <.spx> gained 8.14 points or 0.54 percent, to 1,502.96. The Nasdaq Composite <.ixic> added 19.33 points or 0.62 percent, to end at 3,149.71.

The S&P 500 closed at its highest since December 10, 2007, and the Dow ended at its highest since October 31, 2007.

Apple shares dropped 2.4 percent to $439.88, and the iPhone maker lost its coveted title as the largest U.S. company by market capitalization to Exxon Mobil Corp .

Apple's market cap fell to $413 billion, down roughly $250 billion from its September peak. Apple's fall is about equal to the entire value of Google Inc .

"The market was able to move forward despite deterioration in Apple and that's also a positive," Prudential Financial's Krosby said.

There was heavy volume in Apple shares as it hit its session low shortly before the closing bell. The stock dropped by as much as $7, to $435 from $442, within the span of one second during the last minute of trading.

More than 50 orders were executed on NYSE Arca at $435 a share, according to Thomson Reuters time-and-sales data, in blocks as small as 100 shares and as large as 10,494 shares.

Adding to the overall bullish tone in the market, German business morale improved for a third consecutive month in January to its highest in more than six months. In addition, European banks said they will repay the European Central Bank much more than expected of the loans the bank gave them during the crisis.

"Good news in credit markets helps set the stage for (more investment in) riskier assets," Krosby said.

For the week, the Dow rose 1.8 percent, the S&P 500 gained 1.1 percent and the Nasdaq added 0.5 percent. It was the fourth straight week of gains for all three indexes.

Helping to lift the Nasdaq on Friday, Starbucks rose 4.1 percent to $56.81 after the coffee retailer reported stronger-than-expected sales in the United States and Asia. {ID:nL1N0ATH04]

Netflix added 15.5 percent to $169.56, following its massive 42.2 percent jump on Thursday after the company announced a surprising jump in subscribers to its video streaming service.

Thomson Reuters data through Friday showed that of the 147 S&P 500 companies that have reported earnings so far, 68 percent exceeded expectations. Since 1994, 62 percent of companies have topped expectations, while the average over the past four quarters stands at 65 percent.

Halliburton Co shares jumped 5.1 percent to $39.72 after the world's second-largest oilfield services company reported higher-than-expected earnings and sales for the fourth quarter.

About 6.4 billion shares changed hands on the New York Stock Exchange, the Nasdaq and NYSE MKT, below the daily average during January 2012 of about 6.93 billion shares.

On the NYSE, more than three issues rose for every two that fell. On the Nasdaq, five stocks advanced for every four that declined.
